The legal battle around Nirvana’s iconic smiley face logo continues, with fashion designer Marc Jacobs denying his Redux Grunge collection infringes on copyright.
As The Guardian reports, Jacobs’ lawyers have filed a motion of dismissal which admits he was inspired by “vintage Nirvana concert T-shirts from the 1990s”, but says he “reinterpreted the design”, while calling the logo a “commonplace image”.
The lawsuit also names retailers Saks Fifth Avenue and Neiman Marcus over the collection, which features an altered version of the smiley face across t-shirts, sweatshirts and socks.
Lawyers argue that because it is not an exact replica of the Nirvana design it does not infringe on copyright, while also suggesting the Nirvana estate might not legally own the logo drawn by Kurt Cobain.
Nirvana claims the Redux Grunge collection “damages the goodwill associated with Nirvana and violates its rights in numerous ways".
